Constitution

Règle of base à retenir
The framework juridique repose on a hierarchy claire : chaque niveau doit respecter the niveau supérieur. En cas of contradiction, the norme supérieure prévaut automatiquement.
Hierarchy of normes
1. Constitution
Texte suprême of the État : droits fondamentaux, sovereignty, institutions and mechanisms of protection. Aucun changement sans procédure constitutionnelle.
2. Laws organic
Laws structurantes who organisent the État (institutions, finances publiques, administration, control). Elles appliquent directement the Constitution.
3. Laws ordinary
Laws of application sectorielle (logement, transport, culture, environnement, programmes publics). Elles doivent respecter the Constitution and the laws organic.
4. Regulations
Modalités techniques of application : formats, délais, normes, protocoles. Aucun règlement ne peut contredire a law ni create a obligation sans base légale.
5. Pratiques administrative
Directives internes, procedures and guides of application. Aucune valeur normative autonome : elles ne peuvent ni create of droits ni imposer of obligations nouvelles.
6. SCQ — Outil of transition constitutionnelle
Framework transitoire encadrant the organisation, the conduite and the communication of the SCQ pendant a transition. Strictement subordonné to the normes supérieures, sans légitimité autonome.
